1. Acceptance of Terms

By downloading, installing, or using the Actually mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms form a binding agreement between you and Factual Logic ("we", "us", "our").

2. Description of Service

Actually is an AI-powered fact-checking app that detects claims in real-time audio and conversations, verifies them against trusted sources using artificial intelligence, and presents verdicts with citations. The Service is provided "as is" and is intended as an aid to critical thinking, not as a substitute for professional advice or independent research.

3. User Accounts

To use Actually, you must create an account using a valid email address or sign in with a supported third-party provider (such as Google). You are responsible for:

You must be at least 13 years old to create an account.

4. Subscriptions and Payments

Actually offers paid subscription tiers, including Pro Eternal and Starter plans, which unlock additional fact-checking credits and features. Pricing is displayed within the App at the time of purchase.

5. Free Trial

New users may be eligible for a 7-day free trial of a paid subscription tier. The trial automatically converts to a paid subscription at the end of the trial period unless cancelled before the trial ends. You can cancel the trial at any time through your Google Play account.

Eternal credits earned or granted during onboarding or promotions remain in your account permanently, even if your subscription lapses, in accordance with the App's credit system.

6. Acceptable Use

You agree not to:

7. Games and challenge links

Actually includes games you can play without the microphone. Hunch is a daily set of short claims: you call each one True or False, then the card flips and shows the verdict. Your Move lets you send a friend the same cards as a challenge link, so you can compare scores.

Two more games are played on one phone, passed around a table. Fact or Cap · Hot Seat shows a sentence that is either a real fact or a twisted version of one, and the players call it. Sooner or Later asks players to put events in order by year. The daily line is Sooner or Later played on your own: you place five events around an anchor event. The daily line appears in the app when we switch it on.

Verdicts in Hunch and Your Move. The claims are drafted with AI, then reviewed and approved by a person before they are published, and the verdicts are checked with Actually's AI. Each card shows its source. Verdicts can still be wrong, and the disclaimer under "Limitation of Liability" applies to them. If you think a verdict is wrong, use Dispute in the app or on the challenge page; on the daily web page, the dispute link opens an email to us. A person reviews each dispute. If we got it wrong, both answers count. We cannot say in advance how long a review will take.

Answers in the party games and the daily line. Each card comes from a deck that was drafted with AI, then reviewed and approved by a person before it was published. Nothing is looked up while you play: the answer is the one stored with the card, and it can be wrong. Each card shows its source, and the disclaimer under "Limitation of Liability" applies to these answers too. If you think an answer is wrong, use Dispute. A person reviews each dispute. In a party game, one dispute per game can void the turn it was made in, so that turn does not count; otherwise points at the table stay as they are. On the daily line and on challenge links, if we got it wrong, both answers count.

Class pages. The Class link, link.actuallyai.app/class, currently opens actuallyai.app. Class pages carry no student accounts: students do not sign up, sign in or give a name.

8. Intellectual Property

The Actually app, its branding, logos, software, and design are owned by Factual Logic and are protected by copyright and other intellectual property laws.

You retain ownership of any content you submit to the App (including audio recordings and text). You grant us a limited, non-exclusive license to process your content solely to provide the Service.

9. Limitation of Liability

Important: fact-checks produced by Actually are generated by artificial intelligence. They may contain errors, omissions, or outdated information. Use them at your own discretion and verify important claims independently before relying on them.

To the maximum extent permitted by law, Factual Logic, its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to decisions made based on AI-generated fact-checks.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

10. Termination

We may suspend or terminate your account at any time, without notice, if you violate these Terms or engage in abusive behavior toward our Service, infrastructure, or other users. You may delete your account at any time through the App or by contacting us (see our Privacy Policy).

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated to you via email or through the App at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Italy. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts of Italy, within the European Union, except where mandatory consumer protection laws of your country of residence provide otherwise.
