By downloading, installing, or using the Actually mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms form a binding agreement between you and Factual Logic ("we", "us", "our").
Actually is an AI-powered fact-checking app that detects claims in real-time audio and conversations, verifies them against trusted sources using artificial intelligence, and presents verdicts with citations. The Service is provided "as is" and is intended as an aid to critical thinking, not as a substitute for professional advice or independent research.
To use Actually, you must create an account using a valid email address or sign in with a supported third-party provider (such as Google). You are responsible for:

Actually offers paid subscription tiers, including Pro Eternal and Starter plans, which unlock additional fact-checking credits and features. Pricing is displayed within the App at the time of purchase.
New users may be eligible for a 7-day free trial of a paid subscription tier. The trial automatically converts to a paid subscription at the end of the trial period unless cancelled before the trial ends. You can cancel the trial at any time through your Google Play account.
Eternal credits earned or granted during onboarding or promotions remain in your account permanently, even if your subscription lapses, in accordance with the App's credit system.

The Actually app, its branding, logos, software, and design are owned by Factual Logic and are protected by copyright and other intellectual property laws.
You retain ownership of any content you submit to the App (including audio recordings and text). You grant us a limited, non-exclusive license to process your content solely to provide the Service.
Important: Fact-checks produced by Actually are generated by artificial intelligence. They may contain errors, omissions, or outdated information. Use them at your own discretion and verify important claims independently before relying on them.
To the maximum extent permitted by law, Factual Logic, its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to decisions made based on AI-generated fact-checks.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
We may suspend or terminate your account at any time, without notice, if you violate these Terms or engage in abusive behavior toward our Service, infrastructure, or other users. You may delete your account at any time through the App or by contacting us (see our Privacy Policy).
We may update these Terms from time to time. Material changes will be communicated to you via email or through the App at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Italy. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts of Italy, within the European Union, except where mandatory consumer protection laws of your country of residence provide otherwise.
